Influencer marketing doesn’t have to be complicated. It works best when brands and influencers take the rigidity out of discussions and really get to the heart of the matter — sharing content about a brand that you both love. However, it’s still important to have a simple influencer agreement in place so that both the influencer and your brand know exactly what is expected for their promotion of your brand. 

Your next marketing campaign should engage your influencers’ creativity and help them share about your brand in a way that feels natural and authentic. However, in order to be protected and to set clear expectations for all parties involved, it’s important to outline what you expect from the influencer collaboration and have them agree to this influencer contract. 

Do My Influencer Agreements Need to Be Legal Documents? 

At its core, your influencer agreement should detail the working relationships between the influencer and your company. You can outline the terms and conditions for partnering with your brand. It should list all the requirements for the advertiser and influencer. 

One important consideration is making sure that your influencer content is FTC compliant. The Federal Trade Commission requires that you be transparent in your advertising, which includes having influencers disclose when they were compensated in exchange for their post. You can get more information about FTC regulations here, but you should include FTC requirements in your agreement to ensure that influencers are compliant with these regulations. 

Most businesses do not have the resources to pay a lawyer every time they work with an influencer. To comply with all applicable laws and regulations, it may be necessary to create a template and have it looked over by a lawyer, but you probably don’t have to see a lawyer every time you use this template.

Setting Clear Expectations

The #1 goal for your influencer agreements should be to set clear expectations that can help keep influencer advertiser relationships clear. The content creators/influencers that you work with shouldn’t have to struggle through difficult or subjective requirements, but instead should be able to focus on content creation with a clear set of guidelines. 

As brand ambassadors, they should have a clear understanding of how you want your brand represented online and you should do everything possible to avoid confusion within the influencer relationship. 

Setting clear expectations starts with the initial discussions. Agreements made with your influencer contract template shouldn’t feel like they are coming out of the blue. Instead you should tailor the agreement to what you’ve already been discussing. This will help to pin down the exact needs of this campaign so that everyone is on the same page. 

Social Media Influencer Agreement Template

You can use a social media influencer agreement template in order to work out the details of your partnership. 

Your contract template should include: 

  • What advertiser products you are sending to the influencer
  • What the influencer is required to post (including how often they should post)
  • Any phrases they should include (or exclude) when mentioning your brand
  • How you expect to be tagged or mentioned in the influencer’s posts
  • Links to all your social media, so that the influencer doesn’t have to search for the right links
  • Any additional compensation you’ve agreed to provide to the influencer

Here’s what an influencer agreement can look like: 

Influencer will provide 2 Instagram posts, 4 Instagram stories by June 22, 2020

In exchange for these posts, BRAND will provide 3 bracelets, worth $100

The influencer should tag @brand in each of their posts and stories, and include “Check out the rest of their bracelet selection at the link in bio @BRAND” as the Call-to-Action for each post. 

BRAND will also provide 10% commission on any sale using coupon code INFLUENCER.

This example of an influencer agreement provides clear deadlines and requirements for partnership, while keeping it brief and effective. In the end, you’ll avoid a lot of confusion if you take the time to set clear expectations through an agreement.
